The products, content and services available on the Site are provided to you subject to: (i) the terms and conditions set forth herein, (ii) the Privacy Policy, and (iii) other terms and conditions and policies which you may find throughout our Site in connection with certain functionality, features or promotions as well as customer service, all of which are deemed a material part of and incorporated within these terms and conditions (collectively, "Terms and Conditions").

Using, accessing, browsing or purchasing items on Our Site constitutes your understanding and agreement to be bound by the Terms and Conditions and expresses your acknowledgement that you have read and understood them and consented to them. We update our Terms and Conditions periodically and your access and use of the Site will be subject to the version of the Terms and Conditions effective as of the time of your use.

2. Eligibility. Restrictions on Use of the Site by Minors

We welcome our visitors, but we want to ensure that the visit and use of the Site is conducted in a responsible manner. 3. Product Availability and Use

The availability of our products may vary.  We do not guarantee that all of our products will be available at all times.  Out-of-stock products may be pre-ordered.  The products that we offer on the Site are exclusively for personal use.   You are not authorized to distribute, sell or resell any of our products, gifts, or samples that you purchase or receive from us.  We reserve the right, at our own discretion, to cancel any orders for any suspected violation of our Terms and Condition.

Product prices are provided for informational purposes only and are not binding.  We reserve the right to change prices, based on market conditions, without notice.  Purchases will be subject to the prices as posted on the Site as of the time of making the purchase.  We do not provide price adjustments for any changes in prices.

4. Proprietary Rights

All information and content available on the Site and its look and feel, including but not limited to domain name, trademarks, logos, service marks, trade names, content, features, designs, colors, product design, product features and descriptions, write-ups, functions, text, graphics, logos, button icons, images, audio clips, data compilations and software, and the compilation and organization thereof (collectively referred to as the "Proprietary Material") constitutes worldwide intellectual property of Rosso Corsa or the property of our exclusive licensors.  The Proprietary Material is protected by United States and international laws, including laws governing copyrights, service marks and trademarks. Except for the very limited license set forth in Section 7 below, or as required under applicable law, the Proprietary Material or any portion of the Site cannot be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose whatsoever.

5. Restrictions on Use of the Site.

You are not authorized to: (i) modify, reverse engineer or create any derivative works based upon the Site or any Proprietary Material; (ii) frame or utilize framing techniques to enclose the Site or any portion thereof; (iii) use any meta tags, "hidden text", robots, spiders, crawlers, or other tools, whether manual or automated, to collect, scrape, index, mine, republish, redistribute, transmit, sell, license or download the Site, Proprietary Material (except caching or as necessary to view the Site), or the personal information of others without our prior written permission or authorization; (iv) make any use of the Site or any Proprietary Material other than for personal use; (v) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity; (vi) "stalk" or otherwise harass including advocating harassment of another, entrap or harm any third party including harming minors in any way; (vii) intentionally violate any applicable local, state, national or international law; (vii) transmit, upload, post, e-mail, share, distribute, reproduce, or otherwise make available any software viruses, malware, program, code, file, or other material intended to interrupt, disrupt, alter, destroy, or limit any part of the Site; and/or; (viii) engage or make any unsolicited or unauthorized advertising, solicitation or promotional material, including chain letters, mass mailings, or any form of "spam."

6. Warranty Disclaimer.

To the extent maximum permitted by law and without limiting any of the parameters of Section 7 below, Rosso Corsa presents and provides the Site "as is" without warranty, either express or implied, of any kind, including, but not limited to, the implied warranties of merchantability, fitness for a specific purpose, freedom from computer virus, or non-infringement. 

7. Limitation of Liability

Your visit to and use of the Site is at your own will, your own discretion and your own risk.  In no event shall Rosso Corsa, or any of it’s representatives, affiliates, officers, directors, licensors or partners, be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages of any kind (including lost profits) arising out of your use of the Sites or purchases of products made on the Site or the use of the products offered thereof, regardless of the form of action whether in contract, tort (including negligence) or otherwise, and even if Rosso Corsa has been previously advised of the possibility of such damages. Further, neither Rosso Corsa nor our agents, officers, directors, shareholders, partners, or licensors will be responsible or liable (whether in contract, tort (including negligence) or otherwise) under any circumstances for any (a) interruption of business; (b) access delays or access interruptions to the site; (c) data non-delivery, loss, theft, misdelivery, corruption, destruction or other modification; (d) loss or damages of any sort incurred as a result of dealings with or the presence of off-website links on the site; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party websites; (f) any inaccuracies or omissions in content; or (g) events beyond our reasonable control. we make no representations or warranties that defects or errors will be corrected.  In no event shall the maximum aggregate liability of Rosso Corsa, or any of it’s representatives, affiliates, officers, directors, or licensors, exceed one hundred dollars ($100.00). In addition, Rosso Corsa  disclaims any and all liability of any kind for actions or omissions by or defects in products of Rosso Corsa’s suppliers.

8. Accuracy of Site Information

We make reasonable efforts to ensure that the information included in the Site is as accurate as possible. However, Rosso Corsa does not warrant that product descriptions, colors, information or other content available on the Site are accurate, complete, reliable, current, or error-free.  None of the content on the Site is meant to be a medical advice of any kind. The Site may contain incomplete information, typographical errors or inaccuracies and may not be current.  Rosso Corsa reserves the right to correct any errors, inaccuracies or omissions (including after an order has been submitted).  Further, Rosso Corsa may, at its sole discretion, to change or update information on the Site at any time and without prior notice.  If any errors, inaccuracies or omissions relate to pricing and availability, we reserve the right to cancel or refuse to accept any order placed based on incorrect pricing or availability information. We apologize for any inconvenience this may cause.

Rosso Corsa disclaims any and all liability and responsibility for any third party website and any of the information or its accuracy provided on such linked sites and any goods or services provided or purchased from such sites.  Links appearing on our Site are solely for your convenience. They are not an endorsement by Rosso Corsa to its partners of the referenced content, product or services in such third party websites.  You use and access of these third party websites is at your own risk and at your sole discretion and subject to such third party websites terms and conditions.

10. General

You acknowledge and agree that these Terms and Conditions constitute the entire and exclusive agreement between us concerning your use of the Site, and supersede and govern all prior proposals, agreements, or other communications.

We reserve the right, in our sole discretion, to change these Terms and Conditions at any time by posting the changes on the Site. Any changes in the Terms and Conditions are effective immediately upon posting. The continued use of the Sites constitutes your agreement to be bound by Terms and Conditions, and any revisions thereof, as they are posted and in full force on the Site.

The Site does not provide any medical information about the skin or otherwise.

If any of the Terms and Conditions is deemed as unenforceable or invalid as a whole, then these Terms and Conditions shall be modified, to the extent maximum possible, by the adjudicating entity, and shall continue in full force and effect.  The headings in the Terms and Conditions are for convenience only and shall not be used in its interpretation.

Any dispute over the content or use of the Sites shall be governed by the substantive laws of the United States and the State of California.  Jurisdiction and venue of any action or dispute shall be vested solely in the federal and state courts of San Francisco, California.
